Working draft. This text was written by our product team, not a law firm. A lawyer must review it before it goes live, and the details highlighted in amber still need to be replaced with the company's real ones.

1. Website owner

In compliance with Article 10 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico, LSSI-CE), the following identification details of the owner of this website are provided:

  • Company name: PENDING: company name
  • Tax ID (NIF): PENDING: NIF or CIF
  • Registered office: PENDING: full registered office address
  • Registration details: PENDING: Commercial Registry, volume, folio, sheet and entry
  • Contact email: PENDING: owner’s email address. While that address is being set up, write to hola@payezz.app, which is monitored.
  • Domain name: payezz.app

Payezz’s activity consists of providing a subscription software service for billing, sales and customer management for hosting service providers. It is neither a payment institution nor an electronic money institution: payments are processed by Stripe, and the terms of that relationship are described in the terms of service.

2. Purpose

This legal notice governs access to, browsing of and use of the website hosted under the domain payezz.app and its subdomains. Access to the site is free of charge and does not require registration, except in the areas that expressly require it.

Use of the Payezz service, that is, of the software subscribed to as a customer, is additionally governed by the terms of service, the privacy policy, the data processing agreement and the cancellation policy.

3. Terms of access and use

Anyone accessing this website undertakes to do so in accordance with the law, this legal notice and the requirements of good faith. In particular, they undertake not to:

  • Use the site for unlawful purposes, for purposes that infringe the rights of third parties, or in ways that may damage, disable or overload the owner’s infrastructure.
  • Introduce or spread software capable of damaging the computer systems of the owner, its providers or third parties.
  • Attempt to access restricted areas, other people’s accounts or data to which they are not entitled, or circumvent technical protection measures.
  • Systematically and automatically extract the site’s content in order to reuse it for commercial purposes.

The owner may interrupt access to the site, without prior notice, in the event of a breach of these terms or a technical or security incident that makes it advisable.

4. Intellectual and industrial property

The content of this website, including the text, design, navigation structure, databases, source code, images, logos and the Payezz brand, is owned by the owner of the site or used under a sufficient licence, and is protected by Spanish and international intellectual and industrial property law.

Its reproduction, distribution, public communication, transformation or any other form of exploitation without express written authorisation is prohibited. Access to the site does not grant any licence over these rights.

Third-party trademarks, names and logos appearing on the site, for example when comparing Payezz with other solutions on the market, belong to their respective owners and are cited for informational and comparative purposes, without implying any relationship, sponsorship or endorsement.

5. Links to third-party sites

This site may include links to pages operated by third parties. The owner does not control their content or policies and is not responsible for them. The existence of a link does not imply any recommendation of, or relationship with, the linked site.

Anyone wishing to link to payezz.app may do so without prior authorisation, provided that the link leads to the home page or to a complete internal page, does not reproduce the content within another site and does not suggest a relationship that does not exist.

6. Liability

The owner endeavours to ensure that the information published is accurate and up to date, but does not guarantee that it is free of errors or that the content is always current. The product descriptions, comparisons and price estimates on this site are for information purposes only and do not constitute a contractual offer: what is binding is what is agreed in the terms of service.

The owner does not guarantee the continuous availability of the website or the absence of interruptions due to maintenance, system failures or causes beyond its control, and is not liable for damage arising from such interruptions, except where the law does not permit that liability to be excluded.

Nothing in the foregoing limits the owner’s liability for wilful misconduct, gross negligence or personal injury, or any other liability that applicable law declares cannot be excluded.

7. Storage in your browser

This public website does not use analytics, advertising or tracking cookies, nor does it share browsing data with third parties for those purposes.

It does store two items in your browser: the local storage key payezz-theme, which remembers whether you have chosen the light or the dark theme, and the NEXT_LOCALE cookie, which remembers the language you have chosen and lasts one year. They are technical items, do not identify anyone, are not shared with third parties and are deleted when you clear the site’s data in your browser. As they are strictly necessary to provide the service you have requested, they do not require prior consent.

If cookies that do require consent are introduced in the future, the corresponding cookie policy will be published and consent will be requested before they are installed.

8. Data protection

The processing of the personal data of those who visit this site or subscribe to the service is described in the privacy policy. Where Payezz processes data on behalf of its customers, that is, the data that a hosting provider uploads to its own instance, the data processing agreement applies.

9. Changes

The owner may amend this legal notice to adapt it to regulatory or technical changes or to changes in its business. The version in force is the one published on this page, with the revision date shown at the top.

10. Governing law and jurisdiction

This legal notice is governed by Spanish law. For any dispute arising from access to or use of this website, the parties submit to the courts and tribunals of the place of the owner’s registered office, unless applicable law requires a different venue, as is the case for consumers, who may bring proceedings in the courts of their own place of residence.
